New Horizon Law Corporation was founded by Shaun Cody, a Canadian litigator, who is a registered trademark agent in Canada. Shaun is a member of the Alberta Law Society, the Law Society of British Columbia, the College of Patent Agents & Trademark Agents (CPATA), the Intellectual Property Institute of Canada (IPIC) and the International Wine Law Association (Association Internationale des Juristes du Droit de la Vigne et du Vin, AIDV).
Shaun practices in the areas of intellectual property and commercial litigation. Shaun has extensive experience in intellectual property matters, including acting for plaintiffs and defendants in major patent infringement matters, trademark, trade name, and domain name disputes, copyright litigation, and litigation involving misappropriation of confidential information and trade secrets, and related issues involving employee confidentiality obligations. Shaun has acted in disputes over rights to an invention, including in the context of issued or pending patent applications.
Shaun has worked with numerous clients to help them obtain patent and trademark registrations. His work as a registered trademark agent includes trademark advice, drafting, filing and prosecuting trademark applications, and work for applicants and respondents in trademark opposition proceedings. He also assists clients drafting and reviewing licensing and royalty agreements, and non-disclosure agreements.
Additionally, Shaun has significant experience in injunctive remedies related to intellectual property and evidence in commercial litigation matters, including Anton Piller, attachment and preservation orders. Shaun has also obtained accounting and tracing orders from the Court to determine the use and whereabouts of disputed funds.
He has made numerous presentations to the Technology and Intellectual Property subsection of the Canadian Bar Association and to the Intellectual Property Institute of Canada's Calgary chapter on intellectual property issues.
Shaun has acted on several major commercial loss/business interruption claims, as well as misappropriation and fraud claims, associated recovery remedies, and commercial disputes. He has also successfully appeared before all levels of Court in the province of Alberta, the Federal Court and has made successful written submissions to the Supreme Court of Canada.
